Inky Photo Backup Terms of Service
Welcome to Inky Photo Backup (the "App"). These terms are an agreement between you and 墨鱼卷 ("we" or "us") about your use of the App. Please read them carefully before use, especially the terms in bold. By tapping Agree or starting to use the App, you confirm that you have read and agree to these terms and the Privacy Policy.
1. The Service
The App is a tool that runs locally on your iPhone for backing up, browsing, restoring, and sharing photos and videos between your iPhone photo library and your own external drive or USB flash drive. The App does not provide cloud storage and requires no account. All data is stored on your device and on the drive you choose.
2. Conditions of Use
- You must use the App lawfully and must not use it to infringe the privacy, likeness, copyright, or other legal rights of others, or to store or distribute illegal content.
- You must have the legal right to the photos and videos you back up, restore, or share.
- The App supports backing up to drives formatted as exFAT or APFS; drives formatted as FAT32, NTFS, HFS+, and similar formats can only be browsed and restored.
3. Data and Backup Responsibility
- You are responsible for keeping and managing your photos, videos, and all data on the drive. We have no access to them and cannot recover them for you.
- Damage to or loss of the drive, unplugging the drive or losing power during a backup, or changing or deleting backup files on a computer may cause data loss or incomplete backups. Keep more than one backup of important photos (for example, on two drives or on another storage device) rather than relying on a single drive.
- Before deleting photos from your library in the App, make sure they are backed up. Deleted photos move to Recently Deleted in Photos and are permanently deleted by the system after 30 days.
- Do not rename, move, or delete the "PhotoBackup" folder on the drive or the hidden ".meta" folder inside it on a computer; otherwise the App may not recognize existing backups.
4. Disclaimer
- The App is provided "as is." We do our best to keep it working properly and backup files intact, but to the maximum extent permitted by law, we are not liable for data loss or damage caused by drive failure, system limitations, user error, or force majeure.
- The App relies on capabilities provided by iOS, such as Photos, Files, and background execution. Changes to these capabilities may affect some features; we will do our best to adapt.
- Content sent to other apps or devices through the system share sheet is the responsibility of the recipient.
5. Intellectual Property
We own the intellectual property rights in the App's software, interface design, icons, and related documentation. Rights to the photos and videos you back up and manage belong to you or their original owners; we claim no rights to them.
6. Changes to These Terms
We may update these terms as features change. After an update, we will show you the new version the next time you open the App and ask you to confirm. If you do not agree to the updated terms, you may stop using the App.
7. Governing Law and Disputes
These terms are governed by the laws of the People's Republic of China (for the purposes of these terms, excluding the laws of the Hong Kong and Macao Special Administrative Regions and Taiwan). Any dispute arising from these terms shall first be resolved through friendly negotiation; if negotiation fails, either party may file a lawsuit with the competent people's court at our location.
